Call for Consultancy: Development of a position paper on transparency reforms in the mining sector in Zimbabwe.
- Background
The Zimbabwe Environmental Law Association (ZELA) is a public interest environmental law organization working on the promotion of environmental justice in Southern Africa through sustainable and equitable utilization of natural resources and environmental protection. ZELA is implementing a project focused on Strengthening Mining Fiscal Transparency and Accountability in Zimbabwe. As a part of this project ZELA developed gaps analysis papers indicating the fundamental issues in laws governing the mining sector. Based on these papers, it is apparent that Zimbabwe’s Statutory Scheme does not adequately provide constitutional guarantees of substantive rights. The Constitution provides several guarantees of ‘good governance’ and substantive rights that have not been realized through the current statutory scheme. The law presents several statutes that provide for further government action in the realm of substantive rights. Although a number of statutes detail the governance of resource extraction and related processes, they are inadequate to meet the constitutional guarantees of good governance. This creates a case that the government is required to pass additional legislation to fulfil its constitutional guarantees regarding good governance of the mining sector.
Based on this background ZELA seeks a Consultant to come up with a position paper to stir more citizen action on transparency reforms in the mining sector.
- Main objective of the Position paper
To provide an overview of the avenue(s) that have the greatest probability of most incentivizing action towards greater transparency legal reforms in the mining sector
The Consultant will be expected to:

Working closely with ZELA the following deliverables will be expected from the Consultant within 10 days of engagement:
- Timeline
The assignment will be conducted from the 20th of September 2020 to the 30th of September 2020. The final position paper must be submitted to ZELA by 30th of September 2020.
- Applicant requirements/Relevant qualifications
The ideal candidate should have:
- Demonstrable understanding of economic and political context in Zimbabwe
- Demonstrable experience producing economic governance position papers in Zimbabwe
- Minimum of an undergraduate degree in Economics or an equivalent. Possession of a Masters’ degree will be an added advantage
- Demonstrable understanding of transparency standards like the Extractive Industries Transparency Initiative; Africa Mining Vision among others

Persons with demonstrable experience of conducting similar researches are encouraged to submit: An Expression of Interest (EOI) which is not more than 5 pages. The EOI must detail applicant’s understanding of the TORs and costs; a cover letter summarizing applicant’s skills and past experience relevant to conducting this kind of assignment; applicant’s Curriculum Vitae, with names of three referees and their contact details (email and phone). Applications which do not contain all the above documents will be regarded as incomplete and will not be considered.
