  1. THE TRUSTEES OF ARDA TRANSAU RELOCATION DEVELOPMENT TRUST VS ZIMBABWE ELECTRICITY TRANSMISSION AND DISTRIIBUTION COMPANY(ZETDC) (PVT) LTD HC 88/20

In the wake of Covd 19 the residents of Arda Transau found themselves without access to safe and clean water as provided for in terms of section 76 of the Constitution of Zimbabwe. The residents had to rely on water from Odzi river for other domestic use. The reasons why they had no water was because the Zimbabwe National Water Authority pumps  within the community had been disconnected by the Respondent due to a debt of 37 000 Zimbabwean dollars. In the interests of justice Zimbabwe Environmental Law Association litigation Unit filed an urgent chamber Application before Mutare High  Court on 03 April 2020. The matter was set down for hearing on the 4th of April 2020 before her Lordship Justice  Mwayera. As per Justice Mwayera the Respondent was ordered to restore electricity to water pumps within Arda Transau community with immediate effect. It is important to note that  the ZINWA water pumps were  reconnected the day when the application was filed.The impact of this case was the realisation of the community`s right to water and healthy environment in the wake of a deadly disease.
